Data and assets
Under the Order and Annex C, the Client’s content and materials, page structure, URLs, metadata and redirects, the Project’s data and digital assets, and builds, code and instructions can be transferred within the limits of the applicable rights and portability class.
The formats provided for in the SITE Agreement are: an encrypted ZIP archive; structured content in JSON or CSV; a UTF-8 SQL dump of any database; transferable code in a ZIP archive of the repository; and images in the available original formats. If a project has no database of its own, no fictitious database is created for export. The Project-specific information sheet identifies the formats that actually apply.
For SHOP, the catalogue, categories, customers and orders are also included to the extent lawful and technically available, in accordance with Annex C and the applicable portability class. The export formats or APIs actually available for the service and the Client’s account, as documented in the Project information sheet, are used. Transferable project-specific code and any data stored in the Supplier’s systems are distinct from the Shopify platform itself: delivery of Shopify’s source code or an SQL dump of its internal database is not promised. Licences, access arrangements and third-party service limitations are identified in the dependency register; those limitations do not justify withholding data that is owed and can actually be exported.
Compatibility and limitations
The recipient must provide a compatible environment, the necessary licences and, where required, their own accounts and new credentials. Dependencies and transfer limitations are set out in the dependency register. The Supplier’s secrets, other clients’ data and rights in non-transferable components are not handed over. These exclusions do not prevent delivery of data or assets owed under the Agreement or by law.
Requests and time frames
The Client may submit a support ticket or use the certified email (PEC) address specified in the Agreement, stating whether they are requesting a copy, a transfer or deletion. The Supplier responds within five working days under Annex C; this does not postpone the applicable transfer deadlines. For services falling within Chapter VI of Regulation (EU) 2023/2854, the maximum notice period of two months, the ordinary transitional period of no more than thirty calendar days, and the exceptions and extensions in Articles 17.3 and 17.6 apply. After the transition, a data retrieval period of at least thirty calendar days is provided, unless a longer period is agreed.
Costs and termination
Mandatory switching operations are free of charge under Article 17.4. Genuinely separate additional services are performed only after a quotation has been accepted. The standard rate for additional work under the SITE Agreement is €50 per hour plus VAT, unless a different applicable agreement provides otherwise; it is not used to reclassify free switching operations as chargeable work.
For SHOP, any additional work is subject to the rate specified in the Order and an accepted quotation; the costs of the Shopify plan, apps and payment service remain governed by their respective contractual arrangements. They are not converted into a charge for the Supplier’s free switching operations.
The plan price, payment dates and any amounts payable on termination are those set out in the Order and Article 11, together with the relevant Economic Statement. They are not a technical export fee and are not used to prevent compliance with mandatory obligations. This page does not amend an Order that has already been signed.
SITE/SHOP frontend and included infrastructure
The SITE/SHOP frontend is hosted on Cloudflare Workers with Workers Static Assets in the account held by Wake Up Italy SRL. Publication and distribution of pages, scripts and files, execution of the routing Worker and the Project’s HTTPS configurations are included. Cloudflare costs are borne by the Supplier and included in the price. The Supplier’s account and general resources remain with the Supplier; the Project’s sources, build and non-secret configurations are transferable in accordance with Annex C and R.D. For SHOP, Shopify constitutes the separate commercial backend, in the Client’s account and at its expense; the plan and connection are defined before activation, in accordance with R.D.
Project data and stores
Published pages and content reside in the frontend build files distributed through Workers Static Assets. The standard configuration does not include a dedicated persistent visitor database. Within the siti.gratis platform, D1 stores structured Project management and preparation data, including information and the catalogue supplied by the Client; R2 stores Project materials, files and artifacts. These stores are distinct from the Shopify commercial backend. Request data necessary for website distribution and protection are described in R.S and are not, by reason of that, recorded in the Project’s D1 database. Any additional website stores, forms or processing are identified and documented before activation, with data categories, purposes, retention periods and applicable export format.
Transferable resources and delivery formats
The transfer includes, within the limits of the Client’s rights, a ZIP archive of the frontend sources, the HTML/CSS/JavaScript build and media files, the dependency manifest, build and publication instructions and non-secret configurations for the Worker, domain and API connections relevant to the Project. Structured Project data in D1 are delivered in JSON or CSV; UTF-8 SQL is used for a dedicated store where applicable, without other clients’ data. R2 files are delivered in their original formats with a file list. Delivery is prepared by the Supplier in accordance with Annex C and does not require an automatic export function in the dashboard. The recipient provides a Cloudflare account or compatible hosting, domain/DNS, permissions and credentials; the Supplier’s secrets are replaced. The general account, other clients’ resources and Cloudflare’s proprietary infrastructure are not transferred. Dependency licences remain applicable. Transfer may require reconfiguration and verification; class B stated in the Order remains applicable.
SHOP: Shopify backend and data transfer
For SHOP, integration of the Cloudflare frontend with the Shopify commercial backend is provided for in the account held by the Client and at its expense. The connection to be configured before activation uses the Storefront API for catalogue and cart and Shopify checkout. The plan, authorisations and configuration are defined before connection. Products, customers and orders are extracted using the respective Shopify CSV exports; collections and product relationships through the GraphQL Admin API in JSON or, where supported, bulk operations in JSONL. The product category available in CSV is distinct from collections: the product CSV does not, alone, export collections. Image files and other transferable media are collected in their original formats with a list; links in the CSV do not replace delivery of the files. Extraction is carried out with the Client’s authorisations, within the limits of available fields and functions, identifying any actual exclusions separately before transfer. Shopify is not included as a sub-processor appointed by the Supplier: the Client enters into its own relationship with Shopify. The plan, paid apps and payment processing fees are payable by the Client; included integration activities remain within the contractual price. Transfer of the frontend does not transfer Shopify software or infrastructure, apps or payment services. The Client retains the Shopify account or provides another service; a different platform may require conversions and adaptations. The guarantees, timeframes and transition assistance in Annex C remain unaffected.
